Bobcat Telematics System General Information and Privacy Notice

  1. Doosan Bobcat Korea Co., Ltd. (“Bobcat”, “we”, “our”) is providing you this statement because you operate a Bobcat® machine that is equipped with a telematics system. The telematics system collects information about the equipment, including its condition and operational data and transmits this data to Bobcat, our affiliates and our official dealers.
     
  2. We are committed to handling personal information in compliance with applicable laws. This Privacy Notice explains how we collect, manage, and protect your personal information collected via the telematic system, your rights and how you can contact us. Please note that Bobcat is responsible for proper functioning and support of the telematics system in the Asia, Latin America and Oceania (i.e., Australia and New Zealand) (“ALAO”) regions only.
     
  3. What Information We Collect: The information collected and transmitted by the telematics system (“Telematics Data”) includes, but is not limited to:                                      
  • Equipment model number
  • Equipment serial number
  • Equipment real-time GPS location
  • Engine hours
  • Engine performance data (e.g. engine speed, engine oil temperature and pressure, and fault codes)
  • Hydraulic performance data (pressure and temperature)
  • Fuel level and usage
  • DEF performance data (level, concentration, and temperature)
  • Other diagnostic or performance data
  1. How Personal Information Relates to Telematics Data: Some Telematics Data may reveal personal information through the location of the equipment in relation to which the Telematics Data is collected. Although we do not intend to identify any private individual, we would like to inform you about our data processing activities and about your rights as a data subject.
     
  2. Your Ability to Choose. The information collected from you via the telematics system helps us communicate with you in addition to the uses identified in Article 8 of this Privacy Notice. You may, at any time, opt out of sharing Telematics Data with us by contacting your dealer or contacting us at the contact information below. Please note that opting out will limit our ability to provide the telematics services as well as maintenance, support or diagnostic services on your machine, and prevent us from delivering updates or promotional information about Bobcat products and services.
     
  3. Who Controls Your Personal Information: The controller processing personal information is Doosan Bobcat Korea Co., Ltd., with registered office at 468 Injung-ro, Dong-gu, Incheon, Korea. In case the machine that you operate was distributed by one of our dealers, your dealer might also process your personal information for their own purposes. If so, such dealer is an independent controller of your personal information. It is possible that the owner of the machine (e.g. your employer) also receives telematics information reports concerning the machine that you operate from the dealer for other purposes than our purposes as listed below. The owner of the machine is then an independent controller. Both your dealer and the machine owner may provide you with more information about these processing activities that relate to your personal information.
     
  4. Fair and Lawful Processing: In case we process your personal information, we only do this in a fair and lawful manner. We only collect your personal information from the telematics system for the specific purposes as set out below, and we will not further process personal information in ways incompatible with those purposes.
     
  5. How We Use Information: We use Telematics Data for the following purposes:
  • To fulfill customer support agreements, perform maintenance and repairs, and deliver rental equipment or parts (Telematics Data may be required for these services),
  • To monitor and manage equipment health and efficiency,
  • To continuously improve the user-experience and efficient use of the machine that you operate and to improve the performance of our telematics services,
  • To conduct market research and improve Bobcat’s products and services, and
  • To inform machine owners about specific promotions, special offers or updates related to our services and products.

We only use or disclose personal information for the purposes outlined with the above, or when required by law. Bobcat does not sell your information.

  1. Lawful Basis for Collection and Use of Personal information: We collect and process your personal information based on the following lawful bases: (i) for the purposes set out in Article 8 of this Privacy Notice, (ii) to comply with our legal obligations, (iii) to comply with any reasonable request from competent law enforcement agents or representatives, judicial authorities, governmental agencies or bodies, including competent data protection authorities, or (iv) for purposes where your explicit consent is required, such as direct marketing communications.
     
  2. Data Security and Retention: We take reasonable steps to protect the Telematics Data. These steps include safeguards in our policies, processes, and systems. We implement appropriate technical and organizational security measures, including encryption and access controls, to protect your telematics data against unauthorized access or misuse.

Personal information is retained only as long as necessary to fulfill the purposes listed in Article 8 or to comply with legal requirements. Data that is no longer needed will be securely deleted or anonymized.

  1. Cross-Border Data Transfers: We may disclose and transfer overseas the collected Telematics Data, including personal information, to our affiliate and its third-party vendor(s) located in the United States to process and store such data and in the European Union to access such data. We implement appropriate safeguards to afford an appropriate level of protection of personal information consistent with the Australian Privacy Principles and the New Zealand Information Privacy Principles, including implementation of security measures (e.g., encryption protocols, secure networks) to ensure the safety and confidentiality of personal information while stored in or transmitted to the United States or obtain your consent.
     
  2. Your Rights: You have the right to request information about the personal information we process about you and to access such personal information. You have the right to ask to correct any personal information pertaining to you that is inaccurate, outdated or incomplete data, free of charge. If we do not make any corrections you request, you may provide us with a statement of the correction sought and request that it be attached to the information you have asked to be corrected so that it is read with the information. You also have the right to file a complaint with the competent data protection authority (in Australia, Office of the Australian Information Commissioner (OAIC); in New Zealand, Office of the Privacy Commissioner).
