This CUSTOMER END USER LICENSE AGREEMENT ("EULA") is a binding agreement between Clark Equipment Company doing business as Bobcat Company, a Delaware corporation, having a place of business at 250 East Beaton Drive, West Fargo, North Dakota 58078 ("Bobcat"), and the person, governmental organization, or other legal entity purchasing, renting or leasing the Product (defined below) ("Customer"). 

This DEALER END USER LICENSE AGREEMENT ("EULA") is part of the Dealer Sales Agreement ("Dealer Agreement") in effect between Clark Equipment Company doing business as Bobcat Company, a Delaware corporation, having a place of business at 250 East Beaton Drive, West Fargo, North Dakota 58078 ("Bobcat") and the dealer participating in the Features On Demand Limited Launch("Dealer"). In the event of conflict between this EULA and the dealer’s current Dealer Sales Agreement (“Dealer Agreement”), this EULA shall control with respect to Software, and the Dealer Agreement shall control with respect to all other terms and conditions.  BY PARTICIPATING IN THE FEATURES ON DEMAND LIMITED LAUNCH, DEALER ACCEPTS THIS EULA AND AGREES TO BE BOUND BY ITS TERMS.

Bobcat Company is providing you this statement because your Bobcat machine is equipped with a telematics system or you have received a telematics system accessory. The telematics system transmits information about the equipment, including its condition and operational data, to Bobcat Company and its dealers and partners.

This information may include, but is not limited to:

• Equipment model and serial number
• Equipment location
• Engine hours
• Engine performance data (e.g. engine speed, engine oil temperature and pressure, and fault codes) 
• Hydraulic performance data (pressure and temperature) 
• Fuel level and usage 
• DEF performance data (level, concentration, and temperature) 
• Other diagnostic or performance data 

Bobcat Company can determine the identity of an owner or operator of a piece of equipment through the use of telematics information and other data.

Bobcat Company is an active member of the open source community and uses a variety of open source software (OSS) in our products.
