Product Recommendation Tool Terms of Use

Product Recommendation Tool is provided by Bobcat Company and its affiliates (together, “Bobcat”, “we”, or “our”) and is designed to answer frequently asked questions about Bobcat products and services. Its responses (the “Services”) are generated using a large language model that draws from a broad array of content, including Bobcat product and support pages, manuals, and content reviewed by humans. This content may not be exhaustive or fully up-to-date. As a result, Product Recommendation Tool’s answers may occasionally provide inaccurate or incomplete information. 

Product Recommendation Tool is not intended to provide professional advice and is not a substitute for official Bobcat documentation or communications. By using Product Recommendation Tool, you agree to these Terms of Use (the “Terms”). 

Acceptable Use 

The Services may only be used to answer your questions about Bobcat products and services. 

Minimum Age 

You must be at least 13 years old, or the minimum age required in your country to use the Services. If you are between 13 and 18 years old, you must have your parent or legal guardian’s permission to use the Services, and they must agree to these Terms. 

Risk of Use 

Using the Services is at your own risk. The Services should not be relied upon as your sole source of truth and do not constitute legal, technical, or professional advice. Product Recommendation Tool’s responses may be inaccurate or incomplete and should not be interpreted or represented as Bobcat’s official views or recommendations. 

Prohibited Activities 

You agree not to misuse the Services, including but not limited to: 

  • Using abusive or offensive language 
  • Spamming or flooding the system 
  • Violating intellectual property rights 
  • Attempting to disrupt or disable the Services 
  • Violating any applicable laws 
  • Reverse engineering, disassembling, or attempting to bypass safeguards 

You may not represent Product Recommendation Tool’s responses as factual or binding. Bobcat reserves the right to limit or revoke access to anyone reasonably believed to have engaged in prohibited activities. 

Data Privacy 

You do not need to provide personal data to use Product Recommendation Tool. Your questions and input will not be linked to you in a personally identifiable way and may be stored for up to 90 days to improve the Services. Modification 

We may modify these Terms at any time without notice. 

Disclaimer of Warranties 

THE SERVICES ARE PROVIDED “AS IS.” EXCEPT TO THE EXTENT PROHIBITED BY LAW, WE AND OUR AFFILIATES MAKE NO WARRANTIES OF ANY KIND (EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE) REGARDING THE SERVICES AND DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SECURITY, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE. 

ANY AGREEMENTS, PROMISES, OR REPRESENTATIONS MADE BY THE SERVICES ARE NON-BINDING AND SHOULD NOT BE RELIED UPON. YOU ARE RESPONSIBLE FOR VERIFYING INFORMATION THROUGH OFFICIAL BOBCAT CHANNELS. 

SOME COUNTRIES AND STATES DO NOT ALLOW THE DISCLAIMER OF CERTAIN WARRANTIES OR THE LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE TERMS ABOVE MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS. IN THAT CASE, THESE TERMS ONLY LIMIT OUR RESPONSIBILITIES TO THE MAXIMUM EXTENT PERMISSIBLE IN YOUR STATE AND/OR COUNTRY OF RESIDENCE. 

Limitation of Liability 

To the maximum extent permitted by law, Bobcat is not liable for incidental, special, or consequential damages.  

Agreement to Arbitrate 

Please read this section carefully. It applies to any dispute between you and Bobcat Company and its affiliates. 

Any controversy or claim arising out of or relating to these Terms or Use or this Web Site shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party.  

The arbitration shall be conducted in Cass County, North Dakota, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Notwithstanding anything to the contrary in the foregoing, Bobcat may obtain from a court any interim or provisional relief that may be necessary to protect Bobcat’s rights or property. 

You may opt out of arbitration within 30 days of accepting these Terms by sending a letter to:

Class and Jury Trial Waivers  

You and Bobcat agree that disputes must be brought on an individual basis only, and may not be brought as a plaintiff or class member in any purported class, consolidated, or representative proceeding. Class arbitrations, class actions, and representative actions are prohibited. Only individual relief is available. The parties agree to sever and litigate in court any request for public injunctive relief after completing arbitration for the underlying claim and all other claims. This does not prevent either party from participating in a class-wide settlement. You and Bobcat knowingly and irrevocably waive any right to trial by jury in any action, proceeding, or counterclaim. 

Severability  

If any part of these arbitration terms is found to be illegal or unenforceable, the remainder will remain in effect, except that if a finding of partial illegality or unenforceability would allow class arbitration, class action, or representative action, this entire dispute resolution section will be unenforceable in its entirety.
